Terms of use

Beta version. What you can expect from Patitas en Casa and PatitasID, and what you cannot.

Version 1.0-beta · In force since 28/09/2026

This is a translation. The Spanish version is the binding one; in case of discrepancy, the interpretation most favourable to the consumer prevails.

1. Who provides the service

The website patitasencasa.es and its services, including the PatitasID section (hereinafter “Patitas” or “we”), are provided by the self-employed person whose details appear below. “Patitas en Casa” and “PatitasID” are trade names, not companies.

2. Accepting these terms

You can browse the public pages without accepting these terms. To use any feature (a check in PatitasID, registration, publishing a listing or applying to adopt) you must accept them by ticking the corresponding box; without that acceptance the feature is not available.

Only people aged 18 or over may use the service.

3. Beta version

Patitas is in a test phase. The service is free and provided “as is” and “as available”, without warranties of any kind, express or implied, as to its accuracy, completeness, timeliness, uninterrupted operation or fitness for a particular purpose.

We may change, suspend or close any feature, or the whole service, at any time, including without notice. Data created during the test phase may be changed or deleted.

4. What the service does

4.1. Adoption platform. Shelters, associations and individuals publish listings to give animals up for adoption free of charge, and interested people send applications. Selling animals through the platform is prohibited. Patitas does not own the animals, is not a shelter or rescue organisation and does not arrange adoptions.

4.2. PatitasID. A tool for checking data before adopting or buying an animal, or before paying. Its specific terms are in the PatitasID tab of this document and form part of these terms.

5. Your responsibilities

You use the service at your own risk. You make every decision (to adopt, buy, pay for or transport an animal, or to trust someone) and you bear the risks involved. Before paying anything or handing over or receiving an animal, check the information yourself: meet the animal, review its documents, consult a vet and use official sources.

You are responsible for everything you publish or enter being truthful and for complying with the law, in particular the animal protection rules of your country (in Spain, Law 7/2023 on the protection of the rights and welfare of animals). In particular:

  • Do not publish animals for commercial purposes, from illegal breeding or from abuse, or protected or dangerous species without the required authorisations.
  • Give truthful information about yourself and about the animal’s health, temperament and documents (microchip, vaccinations).
  • Do not ask for money, donations or any other consideration for an adoption, not even for vet costs already paid. A voluntary donation can never be a condition for an adoption.
  • If you adopt, you take on legal and financial responsibility for the animal from the moment you receive it.
  • Enter other people’s data only for a legitimate purpose, such as checking a transaction you are part of.

6. Patitas is not a party to any agreement

Patitas takes no part in agreements between users or with third parties: it does not charge or receive payments for animals, does not keep animals, does not arrange transport and does not visit homes. We do not check animals or people in person. The adoption agreement, and any contract, is solely between the person giving the animal and the person adopting it.

Pre-adoption or follow-up visits, if any, are agreed and carried out by the person giving the animal. Patitas only offers tools to coordinate them, such as messages and appointments.

Voluntary donations made through the button on an organisation’s profile go directly to that organisation, via Bizum and to the details it provides itself. The money does not pass through Patitas and Patitas is not its recipient.

7. User content and moderation

Each user is responsible for the content they publish. By publishing it, you grant Patitas a free, non-exclusive licence to display it on the site and to promote the service.

We have no general obligation to review content, but we may do so on our own initiative, with automatic filters (for example, the one that prevents publishing texts with sale-related words) and with manual review.

If we remove or restrict your content or your account, we will tell you why. If you disagree, you can ask for a person to review the decision by replying to the notice you receive or by writing to info@patitasencasa.es.

To report illegal content or content that breaches these terms, use the “Report” button on the listing or profile (when signed in) or the contact form, saying where the content is and why you believe it is illegal. Point of contact for users and authorities: info@patitasencasa.es.

8. Identity verification

To publish or edit a listing and to apply to adopt, you must verify your identity. You do not need to do so to browse listings or use PatitasID. You can choose between two ways:

  • Automatic verification with Didit, our provider: photo of the document, selfie, liveness check and biometric comparison. It requires your explicit consent, given separately from these terms.
  • Manual review: you upload a photo of each side of your DNI, NIE or passport and an administrator reviews it. No biometric data is used.

Both ways count the same; the manual one exists so that nobody has to accept biometric processing to use the service. The result only shows that the document belongs to the person, and says nothing about their honesty or intentions. The details are in the Privacy policy.

9. Limitation of liability

To the maximum extent permitted by applicable law, Patitas is not liable for:

  • decisions made on the basis of PatitasID results or any other information on the site;
  • errors, omissions, delays or unavailability of the sources;
  • the acts and content of users and third parties, including deception;
  • the health, behaviour or lawful origin of the animals;
  • indirect damage, loss of profit and financial losses;
  • interruptions, failures and loss of data during the test phase.

If you use the service as an organisation or in the course of a professional or business activity (shelters, associations, breeders, transporters), the total liability of Patitas towards you is limited to €100, to the extent permitted by law.

10. Limits set by law

Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited, in particular for wilful misconduct or gross negligence or for harm to life, physical integrity or health, nor the rights that consumer protection law grants you on a mandatory basis.

If any clause is not valid in your country, it will apply to the extent permitted by law and the rest of the terms will remain in force.

11. Changes to these terms

Each new version is published with its number and date. If the change is significant, we will let you know in advance and you will have to accept the new version the next time you use a feature. If you do not accept it, you can stop using the service and delete your account.

12. Closing and suspending accounts

You can stop using the service whenever you want and delete your account from your profile. We may restrict or suspend your access if you breach these terms or the law; if so, we will tell you why.

13. Governing law and courts

These terms are governed by Spanish law. If you are a consumer, you also keep the protection given to you by the mandatory rules of the country where you habitually reside and you may go to the courts of your place of residence.

14. Language

The Spanish version is the binding one. Translations are provided for ease of reading; in case of discrepancy, the interpretation most favourable to the consumer prevails.
